President Rousseff has named Professor Luiz Edson Fachin, 57, as her chosen candidate for the vacancy in Brazil's Supreme Court. The announcement was made on Tuesday (14), in Brasília.
Before the appointment is made official, however, Fachin will first have to be vetted in the Senate, commanded by Renan Calheiros (PMDB - Alagoas), and obtain the approval of the house.
The position became available after the retirement of Joaquim Barbosa, at the end of July last year. Barbosa retired ten years before legally required to do so.
In recent weeks, President Rousseff has considered naming the new judge on more than one occasion, but she needed to test the water with the PMDB before making the announcement.
Fachin is a specialist in civil and family law, and has been linked with the Supreme Court before, when his candidacy was approved by ex-chief of staff Gleisi Hoffman and ex-minister of communications Paulo Bernardo. Both are PT figures from the state of Paraná, where Fachin also pursued his career.
Founder and partner of the firm Fachin Advogados Associados, Fachin graduated in law at the Universidade Federal do Paraná, and received his master's and doctorate at the Pontifícia Universidade Católica (PUC) in São Paulo.
He studied for his post-doctorate in Canada, was a guest researcher at the Max Planck Institute, in Germany, and a visiting professor at King's College, in the United Kingdom. Currently, he is professor of civil law at the Universidade Federal do Paraná.
