Migration Law: Rules Change for Foreigners in Brazil

In the last month, the Senate approved the Law of Migration, which determines entry and duration of stay of foreigners in the country. The text is awaiting review by President Temer, who has until the 24th to sanction or veto.

Understand the main changes introduced by the law.

POLITICAL RIGHTS
What it states now
Prohibits foreigners from participating in political demonstrations and unions, making radio transmissions and possessing aircraft.

Revision
Guarantees right to peaceful protest and union membership and allows immigrant to assume political office.

GENERAL RIGHTS
What it states now
Foreign residents have the same rights as Brazilians.

Revision
Guarantees the right to: courts, education, health, social programs and services, pension, protection in the workplace, bank account etc.

BORDER DEPORTATION
What it states now
Says that deportation may take place when "convenient to national interests."

Revision
Says that the Public Defender should be sought when a migrant is detained at the border; this prevents immediate deportation by the Federal Police.

HUMANITARIAN VISA
What it states now
Does not penalize anyone who left his or her country due to political instability, war or natural disaster.

Revision
Establishes temporary humanitarian visa (different from refugee visa).

BORDER POPULATION
What it states now
Allows entrance and employment in border cities, but foreigners are not permitted to leave the area or live in Brazil.

Revision
Allows authorization for "acts of civil life" in the city.
