Court Rejects Appeal and Former Brazilian Governor May Go to Jail

The judges of the 5th Criminal Chamber of the Appeals Court of Minas Gerais rejected, in a 3-2 decision, the appeal filed by former governor Eduardo Azeredo (PSDB) against his conviction, on Tuesday (the 24th).

This upholds the decision which sentenced him to 20 years and one month in prison for embezzlement and money laundering.

According to the charges brought against him in 2007, money was embezzled from state-owned companies to fund Azeredo's unsuccessful reelection campaign in 1998.

Although his main appeal has been rejected by and the Supreme Federal Court (STF) determines the execution of sentences after a conviction is upheld, the order for Azeredo's arrest has not been issued.

Despite the fact that his arrest has already been authorized, the appeals court judges understand that he should only be arrested after a final and unappealable decision.

The former governor's defense will file a new appeal, a request for clarifications, and there is no expected date for a decision. His lawyers have already resorted to an habeas corpus with the Superior Court of Justice (STJ). The habeas corpus was rejected by a preliminary decision, but it is still under analysis by Fifth Panel.
