FROM SÃO PAULO
The law prohibiting the trade and production of foie gras in São Paulo was overturned this Tuesday (14).
Sanctioned by Mayor Fernando Haddad, the law, which banned the fatty duck and geese livers as well as the trade of goods made from animal skin - from animals raised for this purpose - would start on August 11.
The National Restaurant Association (ANR) filed a lawsuit on November 8 asking for the suspension of the law. The Association alleged usurpation of jurisdiction and lack of reasonableness. The Association also highlighted the loss that they believe the law would cause.
The law was suspended by Judge Sérgio Rui, the judge rapporteur at the Court of the State of São Paulo, until the final judgment of the Direct Action of Unconstitutionality (Adin).
Therefore, the city of São Paulo can continue selling the ingredient until the Court of Justice (TJ-SP) makes its final decision - not scheduled yet.
The municipality said not to be aware of the decision and will not make any statement until the terms of the injunction are clear.
