If the court receives the complaint, Najila becomes the defendant.

Najila's lawyer, Cosme Araújo, said he could only comment after he had access to the copy of the complaint. "It will be good for us to be near a judge. There are many things to clarify that you will know at the right time," he said.

The rape case involving striker Neymar was filed on August 8 by Judge Ana Paula Gomes Galvao Vieira de Moraes of the South Region 2 Stick to Family Domestic Violence. She accepted a request from the Public Prosecutor of São Paulo. If there is new evidence, the inquiry may be reopened at any time.

During a press conference at the time, prosecutor Flávia Merlini said that the reports from the Forensic Medical Institute (IML) found no sign of violence in Najila. The alleged victim had a finger injury the day after the alleged rape when the model had a fight with Neymar in the hotel room.

The case involving the two came to light on May 31, when  Neymar was accused of assaulting and raping model Najila at a hotel in Paris on the night of May 15.
