Model and TV Presenter Daniela Cicarelli Sues Google for R$94 Million and Wins R$250,000

The outcome of model and TV presenter Daniela Cicarelli's legal battle with Google regarding publication of a sex tape was not what she had expected.
She had sued for nearly R$94 million (US$24 million) in damages, after Google, according to Cicarelli, refused to take down the video, in which she appears having sex on a beach in Spain with her ex-boyfriend.
The figure is the total accumulation of the daily fine established, in 2008, by the São Paulo Court of Justice, if Google did not remove the video from the servers of YouTube, the popular video sharing website which it now owns.
However, the 4th meeting of the Higher Court of Justice, decided instead on Tuesday (13) to award Cicarelli and her then boyfriend, the businessman Tato Malzoni, just R$250,000 (US$64,000) each. Neither the lawyers of Cicarelli, Malzoni or Google were available for comment.
The video was originally published on September 18 2006. The images were recorded by a paparazzi photographer and uploaded to YouTube.
