Supreme Court Authorizes President Temer to Testify in Writing to Federal Police in Investigation

Justice Edson Fachin, rapporteur of the so-called Car Wash cases (Lava Jato) before the Federal Supreme Court, gave authorization for President Michel Temer (PMDB Party) to provide written testimony in the investigation spawned by the plea-bargain testimony of JBS Corporation executives.

The PMDB Party leader will have 24 hours to respond to questions from the Federal Police (PF) once they have been submitted.

The method chosen, according to Fachin, is due to the "exceptionality" of the investigation, since it involves a current President.

He also granted a timeframe of ten days for the PF to finish their investigation and separated the proceedings investigating Temer from the ones against removed senator Aécio Neves (PSDB Party).

After this, it will be up to the Federal General Prosecutor's Office to either launch an accusation or request that the case be shelved.

The Federal General Prosecutor, Rodrigo Janot, is seeking to charge Temer, based on money that was delivered by JBS to removed congressman Rodrigo Rocha Loures (PMDB Party), a former aide to the President.

With the return to the lower house of Osmar Serraglio (PMDB Party), who vacated the Ministry of Justice and turned down the Ministry of Transparency position, Rocha Loures, who was his substitute, lost his position as a congressman.

This scenario complicates Temer's strategy of protecting his former aide, since he no longer has privileged standing.
