Brazil's Supreme Court decided on Thursday (17) that the vaccine against Covid-19 may be mandatory as long as there is a law in this regard. The court made it clear that forced immunization is prohibited but has released the Union, states, and municipalities to pass a law that restricts the rights of people who do not want to be vaccinated.
The vote of the rapporteur, Justice Ricardo Lewandowski, prevailed. He argued that compulsory vaccination could be implemented by "indirect measures" and cited as an example of prohibiting frequent places or exercising certain activities.
He said, however, that the person's consent is required for him to be vaccinated. "Any legal, regulatory or administrative determination to implement forced vaccination of people, that is, without their express consent, is blatantly unconstitutional, that is," he said.
